Terms of service
Introduction
Purchases on ledback.no are governed by the standard terms and conditions for consumer purchases of goods over the internet. Consumer purchases over the internet are mainly regulated by the Contract Act, the Consumer Purchase Act, the Marketing Act, the Right of Withdrawal Act and the E-commerce Act. These laws grant the consumer non-waivable rights. The laws are available at lovdata.no. The terms in this agreement are not intended to limit any statutory rights, but rather to outline the key rights and obligations of both parties in the transaction.
1. The agreement
The agreement consists of these terms and conditions, the information provided in the ordering process, and any specifically agreed terms. In the event of conflicting information, the specifically agreed terms between the parties shall take precedence, provided they do not conflict with mandatory legislation.
The agreement is further supplemented by relevant legal provisions governing the sale of goods between businesses and consumers.

6. Delivery

6.2. Delivery time
The delivery time is normally 1-3 business days after it has been shipped from Ledback.
6.3. Shipping cost
Shipping cost is calculated at checkout, and depends on delivery address and package size.
6.4. Uncollected packages
Unclaimed or undelivered packages will be charged with the costs incurred by Ledback for delivering the products to the buyer, in accordance with section 11. If you wish to exercise your right of withdrawal and the package has already been shipped, you must collect/receive the package and follow the standard withdrawal procedure as described in section 9.
6.5. Transport damage
Any transport damage discovered at the time of pickup must be reported directly to the pickup location or carrier. Damage discovered later must be reported to Ledback as a complaint. Please document the damage with photos and send them to kontakt@ledback.no.
7. Risk of the goods
The risk for the goods passes to the buyer once the goods have been delivered to the buyer or their representative, in accordance with section 6.
8. Right of withdrawal
A consumer may cancel the purchase in accordance with the Norwegian Right of Withdrawal Act: https://lovdata.no/dokument/NL/lov/2014-06-20-27
The withdrawal period expires 14 days from the date the service agreement was entered into, or the date the consumer takes physical possession of the goods.
The consumer must notify the seller of their intention to exercise the right of withdrawal within 14 days from the start of the withdrawal period. All calendar days are included in the deadline. If the deadline falls on a Saturday, public holiday, or other non-business day, it is extended to the next working day.
The consumer bears the burden of proof that the right of withdrawal has been exercised. The standard withdrawal form must be used and can be downloaded here. The completed form should be sent to kontakt@ledback.no. The deadline is considered to be met if the notice is sent before the withdrawal period expires.
Start of the withdrawal period:
- For purchases of individual items, the withdrawal period begins the day after the item(s) are received.
- If the purchase consists of multiple deliveries, the withdrawal period begins the day after the final delivery is received.
When exercising the right of withdrawal, the item must be returned to the seller without undue delay and no later than 14 days from the date the notice of withdrawal was given. The consumer is responsible for covering the direct costs of returning the item. The seller may not charge any fees for the consumer’s use of the right of withdrawal.
The consumer may examine or test the product in a responsible manner to determine its nature, characteristics, and functionality without forfeiting the right of withdrawal. If the testing exceeds what is considered reasonable and necessary, the consumer may be held liable for any reduction in the product’s value.
The seller is obligated to refund the purchase amount without undue delay, and no later than 14 days from the date the seller received notice of the consumer’s decision to exercise the right of withdrawal. The seller has the right to withhold the refund until the product has been returned, or until the consumer provides documentation confirming that the product has been shipped back.
9. Delay and non-delivery - Buyer's rights and deadline for reporting claims
If the seller fails to deliver the goods or delivers them late according to the agreement between the parties, and this is not due to the buyer or circumstances on the buyer’s side, the buyer may - under the provisions of Chapter 5 of the Consumer Purchases Act -depending on the situation, withhold payment, demand fulfillment, cancel the agreement, and/or claim compensation from the seller.
For documentation purposes, any claims related to breach of contract should preferably be submitted in writing (e.g., by email).
9.1. Fulfillment
The buyer may uphold the purchase and demand fulfillment from the seller. However, the buyer cannot demand fulfillment if there is an obstacle the seller cannot overcome, or if fulfillment would cause such significant inconvenience or cost to the seller that it would be disproportionately burdensome compared to the buyer’s interest in having the seller fulfill the agreement. If the obstacle is removed within a reasonable time, the buyer may still demand fulfillment.
The buyer forfeits the right to demand fulfillment if they wait an unreasonably long time before asserting the claim.
9.2. Cancellation
If the seller fails to deliver the goods at the agreed delivery time, the buyer must request the seller to deliver within a reasonable additional deadline. If the seller still fails to deliver within this extended period, the buyer may cancel the purchase.
However, the buyer may cancel the purchase immediately if the seller refuses to deliver the goods. The same applies if timely delivery was essential to the agreement, or if the buyer has informed the seller that the delivery time is critical.
If the goods are delivered after the additional deadline set by the buyer, or after the delivery time that was essential to the agreement, any cancellation claim must be made within a reasonable time after the buyer became aware of the delivery.
9.3. Compensation
The buyer may claim compensation for losses incurred due to the delay. However, this does not apply if the seller can demonstrate that the delay was caused by an obstacle beyond the seller’s control, which could not reasonably have been foreseen at the time of the agreement, avoided, or overcome.
10. Defect in goods - Buyer's rights and deadline for complaints
If a defect is present in the product, the buyer must notify the seller within a reasonable time after the defect was discovered or should have been discovered. A complaint is always considered timely if made within two months of the defect being discovered or reasonably should have been discovered. Complaints must be made no later than two years after the buyer received the product. If the product or parts of it are intended to last significantly longer than two years, the complaint period is five years.
If the product has a defect not caused by the buyer or circumstances on the buyer’s side, the buyer may - under Chapter 6 of the Consumer Purchases Act - depending on the situation, withhold payment, choose between repair or replacement, demand a price reduction, cancel the agreement, and/or claim compensation from the seller.
Complaints to the seller should preferably be made in writing.
10.1. Repair or replacement
The buyer may choose to demand either repair of the defect or delivery of an equivalent item. However, the seller may oppose the buyer’s demand if fulfilling it is impossible or would cause unreasonable costs for the seller. Repair or replacement must be carried out within a reasonable time. As a general rule, the seller is not entitled to more than one attempt to remedy the same defect, unless it is reasonable for the seller to be given another opportunity.
10.2. Price reduction
The buyer may demand a reasonable price reduction if the product is not repaired or replaced. The reduction should reflect the ratio between the reduced and agreed price, corresponding to the product’s value in defective versus contractual condition. If special circumstances apply, the price reduction may instead be set according to the significance of the defect for the buyer.
10.3. Cancellation
If the product is not repaired or replaced, the buyer may also cancel the purchase if the defect is not insignificant
11. Seller's rights in the event of the buyer's breach
If the buyer fails to pay or fulfill other obligations under the agreement or the law, and this is not due to the seller or circumstances on the seller’s side, the seller may - under Chapter 9 of the Consumer Purchases Act - depending on the situation, withhold the goods, demand fulfillment of the agreement, cancel the agreement, and/or claim compensation from the buyer. The seller may also, depending on the circumstances, claim interest on late payments, debt collection fees, and a reasonable fee for unclaimed goods.
11.1. Fulfillment
The seller may uphold the purchase and demand that the buyer pays the purchase price. If the goods have not been delivered, the seller forfeits this right if they wait an unreasonably long time before asserting the claim.
11.2. Cancellation
The seller may cancel the agreement if there is a material breach of payment or other significant breach by the buyer. However, the seller cannot cancel the agreement if the full purchase price has already been paid. If the seller sets a reasonable additional deadline for fulfillment and the buyer fails to pay within that period, the seller may cancel the purchase.
11.3. Interest on late payment/debt collection fee
If the buyer fails to pay the purchase price according to the agreement, the seller may charge interest in accordance with the Norwegian Interest on Overdue Payments Act. In case of non-payment, the claim may - after prior notice - be sent to debt collection. The buyer may then be held liable for fees under the Norwegian Debt Collection Act.
11.4. Fee for uncollected, non-prepaid goods
If the buyer fails to collect unpaid goods, the seller may charge a fee. This fee may only cover the seller’s actual expenses incurred in delivering the goods to the buyer. Such a fee cannot be charged to buyers under the age of 18.
12. Warranty
Any warranty provided by the seller or manufacturer grants the buyer rights in addition to those already guaranteed under mandatory legislation. A warranty does not limit the buyer’s right to file complaints or make claims for delays or defects as described in sections 9 and 10. All Ledback backpacks comes with a 2 year warranty against manufacturing defects.
13. Personal data
The seller is the data controller for any personal data collected. Unless the buyer consents otherwise, the seller may, in accordance with the Personal Data Act, only collect and store personal data necessary to fulfill obligations under the agreement. The buyer’s personal data will only be disclosed to third parties if required to fulfill the agreement with the buyer or in cases mandated by law. Read more in our Privacy Policy.
